Terms of Use
Privacy PolicyThese Terms are the agreement between you and Emmanuel Grinspan, who operates Anouk (“Anouk”, “we”, “us”). They apply to the website at anouk.life, the family space, and the phone calls Anouk makes (together, the “Service”).
By creating an account, joining a family space, or asking Anouk to call someone, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. What Anouk is
Anouk is an artificial-intelligence voice that phones a person you choose (a parent, a grandparent or another relative, called here the “Person”) at a time you set, talks with them, and turns what they share into stories, a life map and short notes that the family can read and listen to in a private family space.
Anouk is not a human, not a medical or care service, and not an emergency service. It does not monitor anyone’s health or safety, and it cannot call for help. If you are worried about someone, contact them, a doctor, or the emergency services in their country.
2. Who can use the Service
- You must be at least 18 years old and able to enter into a binding agreement.
- The details you give us must be true and kept up to date.
- You are responsible for your account and for everything done through it. Tell us at once if you think someone else is using it.
3. Your responsibility for the Person Anouk calls
This section matters most. Anouk only calls someone because a family member asked it to. When you add a Person, you confirm and promise that:
- you are a relative of the Person, or you are otherwise entitled to arrange these calls for them;
- before the first call, you told the Person, in words they understand, that Anouk is an AI voice, that it will phone them regularly, that the calls are recorded and transcribed, and that the family will be able to read and listen to what they say;
- the Person agreed to this, and you will stop the calls if they change their mind;
- the phone number you gave belongs to the Person, and the verification code was read to you by the Person or with their knowledge;
- recording these calls is lawful where the Person lives. Some countries and states require the consent of everyone on a call; getting and keeping that consent is your responsibility;
- if the Person cannot give consent themselves, you have the legal authority to give it for them.
You choose how Anouk introduces itself. If you choose that Anouk does not announce, unprompted, that it is an AI or that the call is recorded, you remain fully responsible for having told the Person beforehand. Anouk never claims to be human and always answers truthfully when asked.
The Person can ask Anouk to stop calling at any time. When they do, the calls stop and their number may be blocked from being called again through the Service.
4. The family space
- The organizer who creates a family space decides who is invited. Everyone in the family space can read and listen to what is in it.
- Invitation links give access to the family space. Share them only with people you trust; you can replace a link at any time.
- When you share a clip or a story outside the family space, you are responsible for that choice and for having the Person’s agreement.
5. Acceptable use
You agree not to:
- have Anouk call anyone who has not agreed, or use the Service to harass, deceive, pressure or exploit anyone;
- use the Service to obtain money, passwords, bank details or other sensitive information from the Person;
- use the Service for surveillance, for collecting evidence against someone, or for any unlawful purpose;
- upload or provide content you have no right to use, or content that is unlawful or harmful;
- try to break, overload, copy, resell or reverse-engineer the Service, get around its limits, or use robots to access it;
- use the Service for a business, a care home or an organisation without our written agreement.
6. Artificial intelligence: what to expect
- The conversations, summaries, stories, translations, life map, answers and notes are produced by AI. They can contain mistakes, omissions or misunderstandings. Check anything important with the Person.
- The notes about how the Person sounded are general impressions for the family, not medical information. They are not a diagnosis, an assessment or advice, and they must never be relied on to decide anything about someone’s health, safety or care.
- Anouk may fail to notice distress or an emergency, and it does not alert anyone in real time.
- Calls may be missed, cut short, delayed or of poor quality because of phone networks or other reasons outside our control.
7. Your content and ours
The recordings, transcripts, stories, photos and details about your family (“Family Content”) belong to you and to the Person, as the law provides. You give us permission to store, process, transcribe, translate and display Family Content, including through the service providers named in the Privacy Policy, only in order to run and improve the Service for your family, to keep it secure, and to meet legal duties. We do not sell Family Content and we do not use it for advertising.
Private parts are not shown to you. What the Person asks to keep between them and Anouk, and other private matters at the level you choose on the family page, are left out of the transcripts, recordings, stories and emails you receive. You agree that we will not give you those parts. We keep a sealed copy, described in the Privacy Policy, which we open only when the law requires it or to protect someone’s life or safety.
The Service itself (the name Anouk, the design, the software, the texts and the voice) belongs to us or to our licensors. These Terms give you a personal, non-transferable right to use it, and nothing more.
If you send us ideas or feedback, we may use them freely, without owing you anything.
8. Beta, price and payment
- The Service is currently offered as a beta. Features may change, be limited or be withdrawn, and the Service may contain errors.
- Access during the beta may be free. We intend to introduce paid plans. We will tell you the price before you are charged anything, and you will be able to choose not to continue.
- When paid plans exist, payments will be handled by a payment provider, and any extra terms shown at checkout (billing period, renewal, cancellation, refunds) will apply together with these Terms.
- We may set limits on usage, such as the number or length of calls.
9. Pausing and ending
- You can stop using the Service at any time, and you can ask us to delete your account and your family space by writing to hello@anouk.life.
- We may pause, limit or end access to the Service, for a family or for everyone, at any time: for example at the end of the beta, if a plan is not paid, if these Terms are broken, if we believe a Person has not agreed to the calls, to protect someone, or if we stop offering the Service. Where it is reasonable, we will tell you first.
- While a family space is paused, calls and AI features stop. We will try to keep what you already have available to read and listen to for a reasonable time, but we do not promise to store it forever.
- If the Service ends, we will try to give you a reasonable opportunity to save your Family Content.
10. No warranty
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we make no promise that it will be uninterrupted, error-free, secure or suitable for a particular purpose, that calls will take place, or that recordings and stories will be accurate, complete or preserved. Keep your own copies of anything you could not bear to lose.
11. Limits on our liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special or consequential loss, for loss of data, profit or opportunity, or for distress, arising from the Service or from these Terms;
- we are not liable for anything that happens to the Person or to anyone else because of reliance on Anouk for health, safety, care or emergencies;
- our total liability to you for all claims is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or 100 US dollars.
Nothing in these Terms limits liability that cannot be limited by law, or takes away rights that consumers have under mandatory law in their country.
12. Your promise to us
If someone brings a claim against us because you broke these Terms, in particular because a Person was called or recorded without the agreement or the legal basis described in section 3, or because of content you provided or shared, you agree to compensate us for the resulting losses and reasonable costs, to the extent the law allows.
13. Changes
We may change the Service and these Terms. If a change is significant, we will tell you in the family space or by email before it takes effect. If you continue to use the Service after a change takes effect, you accept the new Terms. If you do not agree, stop using the Service and ask us to delete your account.
14. Law and disputes
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. The competent courts of Tel Aviv-Jaffa, Israel, have exclusive jurisdiction over any dispute, except where the mandatory consumer law of your country gives you the right to bring a claim in your own courts. Please write to us first: most problems can be solved by talking.
15. General
- These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- If a part of these Terms cannot be enforced, the rest stays in force.
- If we do not enforce a right at once, we have not given it up.
- We may transfer the Service and this agreement to a company that takes over the operation of Anouk. You may not transfer your rights without our consent.
- The English version of these Terms is the binding one. Translations, if any, are for convenience.
